1. Acceptance of Terms

By accessing or using our website at https://royalbuildersmiami.com (the "Site"), requesting a quote, or engaging our services, you ("User," "you," or "your") agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use our Site or services.

These Terms constitute a legally binding agreement between you and Royal Builders Miami, a Florida general contractor licensed under License #CGC1538607, with principal place of business at 1401 Sawgrass Corporate Pkwy, Suite 217, Sunrise, FL 33323.

2. Services Description

Royal Builders Miami provides general contracting services including but not limited to:

  • Home renovation and remodeling
  • Roof repair and replacement
  • Kitchen and bathroom remodeling
  • Interior and exterior painting
  • Gutter installation and repair
  • Flooring installation
  • New home construction
  • Home additions
  • Driveway installation
  • Impact windows and doors installation

All services are subject to separate written contracts and estimates. These Terms govern your use of our website and general relationship with our company. Specific project terms will be outlined in individual service agreements.

3. Estimates and Quotes

3.1 Non-Binding Nature

All estimates, quotes, and pricing information provided through our website, phone, email, or in-person consultations are preliminary estimates only and are not binding offers. Final pricing will be determined in a written contract signed by both parties.

3.2 Validity Period

Estimates are valid for 30 days from the date of issuance unless otherwise specified. We reserve the right to modify pricing due to material cost fluctuations, labor rate changes, or scope modifications.

3.3 Site Inspections

All estimates are contingent upon on-site inspection and may be adjusted based on actual conditions discovered during the inspection or commencement of work.

3.4 No Obligation

Requesting an estimate or quote does not obligate you to hire Royal Builders Miami, nor does it obligate us to accept your project.

4. Intellectual Property Rights

4.1 Ownership

All content on this Site, including but not limited to text, graphics, logos, images, photographs, videos, designs, software, and other materials (collectively "Content"), is the exclusive property of Royal Builders Miami or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

4.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes only. You may not:

  • Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Site

7. Limitation of Liability

7.1 Maximum Liability

To the fullest extent permitted by Florida law, Royal Builders Miami, its officers, directors, employees, agents, suppliers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of (or inability to access or use) the Site
  • Any conduct or content of any third party on the Site
  • Any content obtained from the Site
  • Unauthorized access, use, or alteration of your transmissions or content

7.2 Cap on Damages

In no event shall our total liability to you for all damages, losses, and causes of action exceed the amount you paid to us in the twelve (12) months prior to the claim, or one hundred dollars ($100), whichever is greater.

7.3 Essential Purpose

These limitations apply even if we have been advised of the possibility of such damages and even if a remedy fails of its essential purpose.

8. Indemnification

You agree to defend, indemnify, and hold harmless Royal Builders Miami, its officers, directors, employees, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms
  • Your use of the Site
  • Your violation of any rights of another party
  • Any content you submit to the Site
  • Any false or misleading information you provide

9. Dispute Resolution

9.1 Informal Resolution

Before filing any formal dispute, you agree to contact us at (954) 737-2757 or [email protected] to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 30 days of receiving notice.

9.2 Binding Arbitration

If we cannot resolve the dispute informally, you agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site shall be settled by binding arbitration in Broward County, Florida, in accordance with the Commercial Arbitration Rules of the American Arbitration Association (AAA).

9.3 Arbitration Procedures

  • The arbitration shall be conducted by a single neutral arbitrator
  • Each party shall bear its own costs and fees
  • The arbitrator's decision shall be final and binding
  • Judgment on the award may be entered in any court of competent jurisdiction

9.4 Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the dispute between you and Royal Builders Miami individually. You waive any right to participate in a class action lawsuit or class-wide arbitration.

9.5 Exceptions

Either party may seek injunctive or other equitable relief in court to protect intellectual property rights.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

Any legal action or proceeding (other than those subject to arbitration) arising under these Terms shall be brought exclusively in the federal or state courts located in Broward County, Florida. You irrevocably consent to the jurisdiction and venue of such courts.

11. Modification of Terms

We reserve the right to modify these Terms at any time in our sole discretion. Changes will be effective immediately upon posting to the Site with an updated "Last Updated" date. Your continued use of the Site after changes are posted constitutes your acceptance of the modified Terms.

Material changes will be communicated via prominent notice on our Site or email notification if you have provided your email address.

12. Payment and Financing

12.1 Payment Terms

Payment terms for services will be specified in individual service contracts. Generally:

  • Deposits may be required before work commences
  • Progress payments may be required at specified milestones
  • Final payment is due upon project completion and inspection
  • Accepted payment methods: cash, check, credit card, financing (subject to approval)

12.2 Financing

We offer financing options through third-party lenders. Financing is subject to credit approval. Terms, rates, and conditions are determined by the financing company, not Royal Builders Miami. We are not responsible for financing denials or terms offered.

12.3 Late Payments

Late payments may incur interest charges at the maximum rate permitted by Florida law (currently 12% per annum or the contract rate, whichever is less). We reserve the right to suspend or terminate work for non-payment.

12.4 Liens

Florida law provides contractors with lien rights. Failure to pay may result in a construction lien being filed against your property.

13. Permits and Compliance

13.1 Permit Responsibility

Unless otherwise specified in the service contract, Royal Builders Miami will obtain necessary building permits for contracted work. Permit fees are typically included in project estimates but may be billed separately.

13.2 Homeowner Responsibilities

You are responsible for:

  • Providing accurate property information
  • Obtaining HOA approvals if required
  • Ensuring legal access to the property
  • Disclosing known property defects or hazards
  • Maintaining homeowner's insurance during construction

13.3 Code Compliance

All work will be performed in accordance with applicable Florida Building Code and local ordinances. Changes to plans may be required to meet code requirements.

14. Photography and Marketing

By engaging our services, you grant Royal Builders Miami permission to photograph completed work for marketing and promotional purposes, including use on our website, social media, and advertising materials, unless you explicitly opt out in writing.

We will not include interior photos that show personal belongings or identifiable personal information without your explicit consent.

15. Cancellation Policy

15.1 Before Work Begins

You may cancel a service contract before work begins by providing written notice. Cancellation fees may apply as specified in the service contract, typically:

  • More than 7 days before start: Full deposit refund minus administrative fee ($150)
  • 3-7 days before start: 50% deposit refund
  • Less than 3 days before start: No refund

15.2 After Work Begins

Once work has commenced, cancellation terms will be governed by the service contract. You will be responsible for:

  • All work completed to date
  • Materials ordered (whether installed or not)
  • Labor costs incurred
  • Administrative and restocking fees

15.3 Our Right to Cancel

We reserve the right to cancel or refuse service for:

  • Unsafe working conditions
  • Lack of property access
  • Non-payment or payment disputes
  • Abusive or threatening behavior
  • Misrepresentation of property conditions
  • Discovery of unpermitted prior work that creates liability

16. Warranty and Guarantees

16.1 Workmanship Warranty

Unless otherwise specified in your service contract, we provide a one (1) year warranty on workmanship for completed projects. This warranty covers defects in our installation or construction work.

16.2 Material Warranties

Materials are covered by manufacturer warranties, which vary by product. We will provide warranty information for materials used in your project.

16.3 Warranty Exclusions

Warranties do not cover:

  • Normal wear and tear
  • Damage from misuse, abuse, or neglect
  • Damage from acts of God (hurricanes, floods, earthquakes)
  • Damage from alterations or repairs by others
  • Failure to perform recommended maintenance
  • Pre-existing conditions not disclosed
  • Issues arising from homeowner-supplied materials

16.4 Warranty Claims

Warranty claims must be submitted in writing within the warranty period. We will inspect and repair or replace defective work at our discretion.

17. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to:

  • Acts of God (hurricanes, floods, fires, earthquakes)
  • War, terrorism, civil unrest
  • Government actions or restrictions
  • Labor disputes or strikes
  • Material shortages or supply chain disruptions
  • Pandemics or public health emergencies
  • Utility failures

In such events, performance will be suspended for the duration of the force majeure event, and deadlines will be extended accordingly.

18. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

19. Entire Agreement

These Terms, together with any service contract you sign, constitute the entire agreement between you and Royal Builders Miami regarding your use of the Site and supersede all prior agreements, understandings, and communications, whether written or oral.

20. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of Royal Builders Miami.

21. Assignment

You may not assign or transfer these Terms or any rights granted hereunder without our prior written consent. We may assign these Terms at any time without notice or consent.

22. Survival

Sections that by their nature should survive termination shall survive, including but not limited to: Intellectual Property Rights, Disclaimer of Warranties, Limitation of Liability, Indemnification, Dispute Resolution, and Governing Law.
